By entering The Bathhouse you agree to the conditions of entry contained below and that The Bathhouse has agreed to allow you to enter The Bathhouse and participate in the Recreational Activities on the basis of these acknowledgements and agreements.

You acknowledge and agree that:

you assume all risk of Injury and Illness associated with entering The Bathhouse and participating in Recreational Activities including the risk of Injury or the contraction or aggravation of an Illness that might arise from slipping on wet areas; emergent in, and movement between, extreme hot and cold temperatures; the malfunctioning of equipment; the actions of other guests attending The Bathhouse; and understand that this list is not a complete or exhaustive list of all possible risks;

some or all of the Recreational Activities may not be suitable during pregnancy and you are responsible for seeking your own medical advice and medical clearance before participating in any Recreational Activities whilst pregnant;

You represent that you have no pre-existing Injury or Illness (or any condition that would predispose you to Injury or Illness);

you enter The Bathhouse and participate in any Recreational Activity provided by The Bathhouse Provider, on your own volition and entirely at your own risk;

The Bathhouse may (at your cost) take steps to protect your welfare if you suffer any Illness or Injury whilst at The Bathhouse, including administering emergency medical treatment and ambulance transportation, although The Bathhouse is under no legal obligation to do so; and

any guarantees that would otherwise be implied by law in relation to the supply of services to you by The Bathhouse are excluded in relation to any of the matters referred to in section 139A(3) of the Competition and Consumer Act 2010 (ACL). To the extent any guarantee is implied The Bathhouse’s liability is limited to supplying the services again.

No change or modification of any rights that you may have at law in these conditions of entry are affected in relation to liability for significant personal injury that is caused by The Bathhouse’s reckless conduct as defined in the ACL.

You:

agree, for yourself and anyone entitled to act on your behalf, to hold harmless, waive and release The Bathhouse, its officers, agents, employees, representatives, and successors, and any related entity of The Bathhouse from any responsibility, liabilities, demands, or claims of any kind arising out of your entry into The Bathhouse or participation in any Recreational Activity, including from any liability arising from any Injury or Illness that you suffer; and

must indemnify The Bathhouse for any costs or losses suffered or incurred as a result of any action taken in breach of the waiver and release contained in this clause.

In these conditions of entry:

Illness means any illness or disease, whether physical or mental.

Injury means both physical and mental injury and including the aggravation, acceleration or recurrence of an injury including sprains, ligament damage, broken bones, muscle or other physical injury, mental illness, drowning, slipping, overheating (including heatstroke and any other medical condition arising from using spas, saunas and steam rooms), cardiovascular stress or failure, loss of or complications to pregnancy, and death. 

The Bathhouse means The Bathhouse Pty Ltd ABN 22 654 669 075 their respective officers, employees, agents and representatives;

Recreational Activities means each of the following activities: participating in The Bathhouse including use of pools, spas, saunas, steam room, cold plunge, LED Facial, massage, consumption of food and beverages, use of amenities and other activities. 

By entering The Bathhouse, or participating in any Recreational Activities, you acknowledge and agree that:

you have read and understood these conditions of entry.

you are aware that this is a waiver and a release of liability, and you voluntarily agree to its terms; and

the terms of these conditions of entry apply whether or not you paid to enter The Bathhouse or whether somebody else has paid for you. 

General Conditions of Entry

You must abide by the instructions of the Service Provider’s staff at all times or you may be removed from the premises and refused entry in future. This is to ensure safety and enjoyment for all participants engaged in the Recreational Activities. Your entry into the premises of the Service Provider is on strict condition that you comply with the safety and other general instructions given by the Service Provider’s staff. You will not be given a refund for any unused time should you be removed from the premises for any reason whatsoever and you acknowledge your entry to the premises is strictly on this basis.

On occasion, promotional video or photographs may be used by the Service Provider which may include your image whilst being engaged in Recreational Activities. By signing this document you consent to this use unless you specifically request in writing that your image not be used for this purpose.

You acknowledge that security video is used on the public areas of premises of the Service Provider and consent to this use for security and safety purposes.
